Terms of Service
Draft version 0.2 Β· Last updated September 2026 Β· Effective date: [to be confirmed after legal review]
1. About This Platform
You the Winner ("the Platform", "we", "us") is operated by GoEnhanced LLC, founded by Marcelo AragΓ£o, a family business based in Highland Village, Texas. For the complete Privacy Policy and Terms of Service covering the YTW-Daily Tools subscription app specifically, see tools.you-the-winner.com/terms.html β this page covers the free tools and general use of the you-the-winner.com site. These Terms cover every site and tool under the you-the-winner.com domain and its subdomains, including:
- you-the-winner.com β the parent site, general information, and free caregiver tools
- tools.you-the-winner.com ("YTW-Daily Tools") β the subscription daily-living app: Plans, Money, My Day, Level Up Board, Calendar & Schedule, Calm Corner, Cycle Tracker, Roadmap, Rewards, and Picture Frame Mode
- [name].you-the-winner.com β personalized instances built for individual subscribers, each on their own subdomain (for example, mel.you-the-winner.com)
Individual instances may also offer additional services (such as lessons, consultations, or local business listings) operated by their respective administrators, which may be subject to separate arrangements between you and that administrator.
By accessing or using any part of the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
2. What This Platform Is Not
This is a personal organization and support tool. It is not, and does not provide:
- Healthcare services or medical advice. We are not a covered entity under HIPAA and do not act as a healthcare provider, health plan, or business associate of any healthcare provider.
- Financial advice, investment advice, or financial planning services.
- Legal advice or legal services.
- A substitute for professional medical, financial, or legal consultation.
3. Accounts, Free Trial & Subscriptions
YTW-Daily Tools offers a free demo that requires no account, and a 14-day free trial for signed-in accounts that requires no payment method to start. After the trial, continuing to use the service requires a paid subscription: Personal ($9.99/month or $99/year), Family ($19.99/month or $199/year), Professional Supporter (free when invited by a client), Professional Pro ($29/month or $290/year, founding pricing), or Organization (starting at $499/month) for agencies and larger teams, billed through our payment processor, Stripe (see Section 6). Pricing may change; if it does, we will show the current price before you're charged.
You may cancel a paid subscription at any time. If you cancel, or if we ever discontinue the service, any unused portion of a period you've already paid for is refunded, prorated to the day.
If your free trial ends without an active subscription, your account moves to a trial-expired state: you retain the ability to export or delete your own data yourself, but active use of paid features is paused until you subscribe.
We may suspend or deny access to an account for violation of these Terms, abusive use, or non-payment, consistent with the access controls described in your account's platform instance.
4. Your Responsibilities
You are solely responsible for the accuracy, completeness, and appropriateness of any information you enter into the Platform, including:
- Personal and family information entered into the Family Emergency & Legacy Binder
- Health-related entries: mood, energy, sleep, medication tracking, weight/height, and cycle-tracking data
- Financial account details, income, spending, and budgets
- Any other personal data you voluntarily input
4.1 Sensitive Information and the Word Version
The Platform is designed around a "pointers, not raw data" security model. We strongly recommend:
- Storing only enough information to identify an account (institution name and last 4 digits), not full account numbers, routing numbers, or Social Security Numbers.
- Keeping passwords, PINs, and full government ID numbers in a dedicated password manager or encrypted file, and pointing to that location from within the Binder.
- Storing the downloadable Word version of the Binder in a secure, password-protected location if it contains sensitive personal information.
If you choose to enter full sensitive data contrary to this recommendation, you do so at your own risk. We will not accept liability for consequences arising from your choice to store unredacted sensitive data in a personal organization tool.
4.2 Medical, Cycle, and Body-Measurement Information
Medication lists, diagnoses, behavioral protocols, care instructions, cycle-tracking entries, and weight/height entries are for personal reference only. They do not constitute a prescription, a medical order, or clinical guidance. You are responsible for verifying their accuracy, and we recommend having a healthcare provider review any medical or clinical details before relying on them in an emergency or care decision.
5. Family Plans & Picture Frame Mode
If you join or create a Family Plan, data entered by a plan member may be visible to, and manageable by, the plan owner (typically a caregiver or parent). This is intentional, it's how the Platform supports caregiving relationships, but it means a Family Plan is not a private account in the same way a standalone account is. Talk with your family about what's shared before joining a plan.
Picture Frame Mode ("Kiosk") is an opt-in feature that displays certain account information, a photo, today's weather, your day's message, your schedule, and medication refill reminders, on a screen you choose, for anyone nearby to see. Turning this on and choosing where that device sits is entirely your decision; we have no way to control who can physically view that screen once you've enabled it.
6. Data Storage, Payments & Privacy
When using the online Platform, your data is stored using Google Firebase, a cloud platform provided by Google LLC, subject to Google's own privacy and security policies. Payments for paid subscriptions are processed by Stripe, Inc.; we never receive or store your full card number ourselves. See our Privacy Policy for full details on what we collect, how long we keep it, and your rights.
6.1 Access Control
Personal and family data on the online Platform is protected behind authenticated login. You are responsible for maintaining the security of your login credentials.
6.2 What We Collect
We collect only the information you choose to enter into the Platform. We do not sell your data to third parties. We do not use your personal data for advertising.
7. Limitation of Liability
8. Family Emergency & Legacy Binder β Specific Terms
The Family Emergency & Legacy Binder ("the Binder") is available in two forms: an online version accessible through the Platform, and a downloadable Word document for offline use. The following terms apply to both.
8.1 Purpose and Scope
The Binder is a summary and index tool. It is not a legal document, a substitute for a will, a power of attorney, or any other binding legal instrument. Information recorded in the Binder has no independent legal standing.
8.2 The Word (Offline) Version
A downloadable Word version is provided so families who prefer not to store sensitive information online can complete and maintain the document entirely on their own device. Families may fill in only the sections they feel comfortable with, and leave sensitive fields blank or as a pointer to a secure offline location.
By downloading and using the Word version, you accept that:
- You are solely responsible for the security of the file and any information you type into it.
- We have no access to, and no liability for, the contents of locally stored files.
- You should store the completed document in a secure, access-controlled location (locked safe, encrypted drive, or password-protected folder).
8.3 Estimated Completion Time
Completing the Binder with all information readily available is estimated to take approximately 2 to 3 hours for a thorough first pass.
| Section | Est. Time |
|---|---|
| Quick Start | ~10 min |
| Legal & Estate | ~10 min |
| Household Finances | ~15 min |
| Debts & Loans | ~10 min |

We recommend reviewing and updating the Binder at least once per year. We are not responsible for consequences arising from outdated information that was not reviewed and updated by the user.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Texas, United States. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Denton County, Texas.
